DOH Medical Cannabis Rules Effective October 5, 2021

​​The South Dakota Department of Health went before the Interim Rules Review Committee of the South Dakota Legislature on September 13, 2021 to present rules related to the Medical Cannabis Program. A copy of the approved rules may be viewed here.

SDAHO testified in opposition to a rule requiring physicians to recommend patients for the cultivation of medical cannabis. The South Dakota Medical Association also testified in opposition to the rule. That rule was reverted by the committee by a 5-0 vote. The committee also voted to revert 5 other rules related to bulk packaging, potency or THC concentration, advertising and debilitating conditions of qualifying patients. It was proposed but not passed by the committee to revert rules pertaining to non-resident cardholders and testing requirements as well as directing the Department of Health to draft rules related to cooperation with tribal governments.

The remaining rules were approved by the committee and will be effective on October 5, 2021. The rules may be found in Administrative Rules of South Dakota Article 44:90.
