Approved organizations may hyperlink to the Website as follows:

No use of SDAHO’s logo or other artwork will be allowed for linking, absent a trademark license

SDAHO and its affiliate entities’ social media accounts, including but not limited to, Facebook page(s), X account(s), LinkedIn page(s), and YouTube channel(s) are social media platforms meant for Users to connect with SDAHO and its affiliates and to learn about their programs. SDAHO reserves all rights relating to its social media accounts, including, but not limited to, adding, removing, or modifying any content; blocking harassing and disruptive users; and discontinuing any of its social media accounts at any time.
SDAHO does not warrant that the information on these social media channels is complete, reliable, useful, or otherwise accurate. Do not rely solely on the information presented in these social media accounts for any type of advice. Further, SDAHO does not create or control any opinions or statements expressed by others within these social media accounts, including those that Follow, Like, re-post, or otherwise share SDAHO content therein, nor does any similar action undertaken by SDAHO concerning another User’s content constitute an endorsement by SDAHO of that User.

Indemnification
You agree to indemnify, defend, and hold harmless SDAHO, its members, affiliates, licensors, and service providers, as well as its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, judgments, damages, expenses, costs (including but not limited to attorneys’ fees), losses, or liabilities arising out of or relating to your violation of the Terms or your use of the Website, including, but not limited to any use of the Website’s material and services outside what has been expressly authorized in the Terms. This section will indefinitely survive the termination of these Terms and your use of the Website.
Jurisdiction
The Website, excluding linked sites, is controlled by SDAHO, which is incorporated as a nonprofit corporation in the State of South Dakota, United States of America. The laws of the jurisdictions where users may access the Website differ from those of South Dakota. By accessing the Website, both you and SDAHO agree that the laws of the State of South Dakota, without regard to conflict of laws principles thereof, will apply to all matters arising from or relating to the use of the Website. You and SDAHO also agree and hereby submit to the personal jurisdiction and venue of the Second Judicial Circuit Court of South Dakota and the United States District Court of South Dakota with respect to these matters. SDAHO makes no representation that materials on the Website are appropriate or available for use in other locations and accessing it from territories where its contents are illegal is prohibited. Those who access the Website from other locations do so on their own initiative and are responsible for compliance with local laws.
Waiver and Severability
If SDAHO or any of its affiliates do not exercise or enforce any right set forth in the Terms, SDAHO and its affiliates do not waive that right. If a court finds any provision of the Terms invalid, you and SDAHO agree the court should attempt to follow the intention of the provision and all other provisions of the Terms will remain in effect.
