Updated Medical Marijuana Resources

SDAHO has recently updated resources to help support healthcare facilities with the passage of Initiated Measure 26, the legalization of medical marijuana in South Dakota, effective July 1, 2021.

SDAHO has drafted a series of briefs related to the aspects of the new law that most closely affect healthcare facilities.

  • Qualifying Patients and Written Certification | This brief details the patient and provider relationship, potential risks related to certification under federal regulation, and other requirements for patients to access medical cannabis.
  • Use in Healthcare Facilities | This brief reviews federal regulation and enforcement priorities related to medical cannabis, current protections for healthcare facilities and staff under state law, and provides example policy templates for healthcare facilities to consider related to the presence and use of medical cannabis within their facility.
  • Workplace Protections and Healthcare Workforce | This brief focuses on workplace protections under state law for medical cannabis use among staff.

These briefs will be updated as the South Dakota Department of Health issues rules related to medical marijuana or as future changes are made to state statute. The briefs and other educational resources are available on our website at https://sdaho.org/marijuana/.
