Medical Services Rules Approved by Interim Rules Review Committee

On September 13, the Interim Rules Review Committee of the South Dakota Legislature approved rules proposed by the Department of Social Services Division of Medical Services.

The new rules update current coding manuals, clarify coverage of 90 day fills on eligible generic maintenance medication, clarify fees for personal care services, allow enrolled secure medical transportation providers to also enroll as a community transportation provider, add a definition for telehealth, allow continuation of public health emergency coverage of telehealth services, and add nurse midwifes as a provider visit type within Federally Qualified Health Centers and Rural Health Clinics. The new telehealth definition aligns with the definition passed by the legislature last year in SDCL Chapter 34-52, and includes  interactive audio-visual or audio-only technology.

The new rules will be effective on October 3, 2021. The new rules can be viewed here and corresponding updates will be made to ARSD Article 67:16.
