The Interim Rules Committee of the South Dakota Legislature met on Monday, August 2. The rules committee approved rules from the Department of Social Services Division of Behavioral Health regarding telehealth and audio-only services among other changes. The rules codify telehealth and audio-only service delivery flexibilities put in the place under Executive Order during the COVID-19 Public Health Emergency.

The Council on Community Behavioral Health and Three Rivers Mental Health Center testified in support of the rule changes and the positive impact on service delivery for individuals who reside in locations without internet access.

The Interim Rules Committee voted unanimously to pass the rule changes. The rules will be effective August 22, 2021.

The proposed rules and associated documents are available here.
