Litigants request expedited appeal of 340B lawsuit

The American Hospital Association (AHA) and other litigants recently requested the federal appeals court to expedite the appeal to overturn a lower court’s ruling to dismiss a lawsuit seeking to prevent reductions in payments to providers who participate in the Medicare 340B drug procurement program.

AHA has asked the appeals court to establish a schedule that would ensure completion of all briefing in the appeal by no later than the beginning of April, with a date for oral argument as soon as practical once the briefing is complete.

In addition, SDAHO continues to support H.R. 4392 introduced by Rep. David McKinley (R-WV), which has gained the support of 180 representatives who have signed on as co-sponsors.
