Overview:

The withholding or withdrawing of lifesaving medical treatment (LSMT) when a patient lacks the capacity to make decisions can be a complex and difficult field to navigate. This presentation will address legal distinctions made in LSMT, different types of advance directives, the persons designated to make decisions when patients have advanced directives and when they do not, and the parameters of a surrogate’s decision-making power.

Objectives:
  1. To understand why the law requires clear and convincing evidence for a surrogate or attending physician to authorize the removal of certain life saving treatments and not others;
  2. To distinguish between the advance directive documents and the surrogates and the healthcare providers obligations and limitations under each document;
  3. To clarify the power that surrogate decision makers have and the limitations to that power.
Presenter:

Cameo C. Anders, JD, MA is an attorney with Anders Law Office, Prof., LLC, licensed in the State of South Dakota, and practicing in Sioux Falls.  She serves as: a Community Member on the Avera Ethics Committee and the Avera Health Sciences IRB; a Clinical Assistant Professor with the Section of Ethics and Humanities for USD, Sanford School of Medicine; an Adjunct Professor of Organizational Ethics for the Masters in Health Care Mission through the Aquinas Institute in St. Louis, MO; an advisory board member of Life Circle, SD; and a member of the SD State Bar Ethics and Elder Law Committees.

Ms. Anders received her juris doctorate from Ave Maria School of Law, now located in Naples, FL. She holds a certificate in bioethics with distinction from the National Catholic Bioethics Center in Philadelphia, PA, and a Masters in Theology/Bioethics from Holy Apostles College and Seminary in Cromwell, CT.
