Overview: The withholding or withdrawing of lifesaving medical treatment (LSMT) when a patient lacks the capacity to make decisions
The withholding or withdrawing of lifesaving medical treatment (LSMT) when a patient lacks the capacity to make decisions can be a complex and difficult field to navigate. This presentation will address legal distinctions made in LSMT, different types of advance directives, the persons designated to make decisions when patients have advanced directives and when they do not, and the parameters of a surrogate’s decision-making power.
- To understand why the law requires clear and convincing evidence for a surrogate or attending physician to authorize the removal of certain life saving treatments and not others;
- To distinguish between the advance directive documents and the surrogates and the healthcare providers obligations and limitations under each document;
- To clarify the power that surrogate decision makers have and the limitations to that power.
