Overview:

On June 29, 2022, CMS released revised Long-Term Care surveyor guidance, including clarifications and technical corrections of Phase 2 guidance and Phase 3 guidance. Surveyors began using this guidance to identify noncompliance on October 24, 2022. This CMS surveyor guidance impacted over 50 F-Tags. This educational webinar will select a few of these F-Tags, including abuse and neglect, discharge and arbitration agreements, and explain the updates and changes to these requirements under the regulations and guidance. Attendees will be able to gain knowledge on developing actions plans for achieving compliance related to the updates and changes.

Sean Fahey Attorney, Hall, Render Killian, Heath & Lyman, P.C.

Sean Fahey represents the needs of skilled nursing and assisted living facilities in all areas of health care accounts receivable and reimbursement recovery. He helps clients streamline internal processes and procedures for corporate accounts receivable policies and to provide in-service presentations to teach facility staff strategies for reducing outstanding private and Medicaid receivables. Sean counsels clients on admission agreement language relevant to collection matters and provides advice on discharge planning issues. He also advises clients on compliance, contracts, resident guardianship issues and estate claims.

Sean also focuses his practice on estate planning, trust and estate administration, and general business matters, with an emphasis on the implementation of business succession planning techniques for business owners. He has represented individuals and families in structuring their business transactions as well as planning their personal income tax and estate tax matters. His practice includes advising clients on charitable giving techniques. He is board certified as an Indiana Trust and Estate Lawyer by the Trust and Estate Specialty Board.

Sean is a member of the Elder Law section of the Indiana State Bar Association and the National Association of Elder Law Attorneys and has been a speaker at national and local long-term care conferences as well as at continuing legal education seminars focusing on nursing home issues.
